Bilo da se radi o kupoprodaji, kreditiranju, ovr\u0161nim postupcima ili izvla\u0161tenju, pravilno utvr\u0111ena vrijednost nekretnine klju\u010dna je za za\u0161titu interesa svih uklju\u010denih strana. Upravo iz tog razloga donesen je <b>Zakon o procjeni vrijednosti nekretnina.<\/b><\/p>\n<p data-start=\"343\" data-end=\"636\">Zakon o procjeni vrijednosti nekretnina sustavno ure\u0111uje na\u010din procjene, metode koje se koriste, tko mo\u017ee provoditi procjene te kako se prikupljaju i analiziraju tr\u017ei\u0161ni podaci.<\/p>\n<p data-start=\"854\" data-end=\"976\">Ovaj zakon ima klju\u010dnu ulogu u osiguravanju pravne sigurnosti i transparentnosti tr\u017ei\u0161ta nekretnina u Republici Hrvatskoj.<\/p>\n<hr data-start=\"978\" data-end=\"981\">\n<h2 data-section-id=\"ihmnhu\" data-start=\"983\" data-end=\"1038\">\u0160to ure\u0111uje Zakon o procjeni vrijednosti nekretnina?<\/h2>\n<p data-start=\"1040\" data-end=\"1302\">Zakon o procjeni vrijednosti nekretnina predstavlja <b>temeljni pravni okvir za utvr\u0111ivanje vrijednosti svih vrsta nekretnina u Hrvatskoj. <\/b>Njime se ne ure\u0111uje samo tehni\u010dki aspekt procjene, ve\u0107 i cijeli sustav koji omogu\u0107uje dosljednu i objektivnu primjenu pravila.<\/p>\n<p data-start=\"1304\" data-end=\"1355\">U praksi, zakon ure\u0111uje nekoliko klju\u010dnih podru\u010dja:<\/p>\n<ul data-start=\"1357\" data-end=\"1558\">\n<li data-section-id=\"1r68n5e\" data-start=\"1357\" data-end=\"1399\"><b>metode procjene<\/b> vrijednosti nekretnina<\/li>\n<li data-section-id=\"kuph25\" data-start=\"1400\" data-end=\"1449\"><b>ovla\u0161tene procjenitelje<\/b> i njihovu odgovornost<\/li>\n<li data-section-id=\"1nplsdr\" data-start=\"1450\" data-end=\"1482\"><b>procjeniteljska povjerenstva<\/b><\/li>\n<li data-section-id=\"7txw5f\" data-start=\"1483\" data-end=\"1524\"><b>sustav prikupljanja tr\u017ei\u0161nih podataka<\/b><\/li>\n<li data-section-id=\"1twvuou\" data-start=\"1525\" data-end=\"1558\">izradu <b>procjembenih elaborata<\/b><\/li>\n<\/ul>\n<p data-start=\"1560\" data-end=\"1695\">Ovakav sustavni pristup osigurava da procjene ne ovise o subjektivnoj procjeni pojedinca, ve\u0107 o jasno definiranim pravilima i podacima.<\/p>\n<hr data-start=\"1697\" data-end=\"1700\">\n<h2 data-section-id=\"1vc9j4y\" data-start=\"1702\" data-end=\"1740\">Kada se Zakon o procjeni vrijednosti nekretnina primjenjuje u praksi?<\/h2>\n<p data-start=\"1742\" data-end=\"1922\">Primjena Zakona o procjeni vrijednosti nekretnina obuhva\u0107a <b>gotovo sve situacije u kojima je potrebno utvrditi vrijednost nekretnine<\/b>. To uklju\u010duje svakodnevne pravne i poslovne transakcije, ali i slo\u017eenije postupke.<\/p>\n<p data-start=\"1924\" data-end=\"1976\">Naj\u010de\u0161\u0107e situacije u kojima se zakon primjenjuje su:<\/p>\n<ul data-start=\"1978\" data-end=\"2104\">\n<li data-section-id=\"10njopt\" data-start=\"1978\" data-end=\"2004\">kupoprodaja nekretnina<\/li>\n<li data-section-id=\"jbqxqn\" data-start=\"2005\" data-end=\"2028\">odobravanje kredita<\/li>\n<li data-section-id=\"1be25de\" data-start=\"2029\" data-end=\"2048\">ovr\u0161ni postupci<\/li>\n<li data-section-id=\"lw13lh\" data-start=\"2049\" data-end=\"2067\">sudski sporovi<\/li>\n<li data-section-id=\"f1gno1\" data-start=\"2068\" data-end=\"2083\">izvla\u0161tenje<\/li>\n<li data-section-id=\"1eti016\" data-start=\"2084\" data-end=\"2104\">porezni postupci<\/li>\n<\/ul>\n<p data-start=\"2106\" data-end=\"2366\">Posebno je va\u017eno istaknuti da zakon predvi\u0111a i situacije kada ne postoji dovoljno tr\u017ei\u0161nih podataka. U takvim slu\u010dajevima koriste se modeli procjene koji omogu\u0107uju odre\u0111ivanje vrijednosti na temelju dostupnih informacija<\/p>\n<h2 data-section-id=\"zd5sf2\" data-start=\"2373\" data-end=\"2413\">\u0160to je tr\u017ei\u0161na vrijednost nekretnine?<\/h2>\n<p data-start=\"2415\" data-end=\"2499\"><a style=\"background-color: #ffffff;\" href=\"https:\/\/bridgewellgroup.ca\/definition-of-market-value-in-real-estate\/\" target=\"_blank\" rel=\"noopener\">Tr\u017ei\u0161na vrijednost<\/a>&nbsp;predstavlja <b>sredi\u0161nji pojam ovog zakona<\/b> i <b>temelj za sve procjene.<\/b><\/p>\n<p data-start=\"2501\" data-end=\"2607\">Rije\u010d je o vrijednosti koju bi nekretnina postigla na tr\u017ei\u0161tu u trenutku procjene, pod sljede\u0107im uvjetima:<\/p>\n<ul data-start=\"2609\" data-end=\"2739\">\n<li data-section-id=\"1q9soiq\" data-start=\"2609\" data-end=\"2652\">kupac i prodavatelj djeluju dobrovoljno<\/li>\n<li data-section-id=\"1tqw8xf\" data-start=\"2653\" data-end=\"2683\">obje strane su informirane<\/li>\n<li data-section-id=\"1l2jz3f\" data-start=\"2684\" data-end=\"2706\">ne postoji prisila<\/li>\n<li data-section-id=\"oi9jq5\" data-start=\"2707\" data-end=\"2739\">tr\u017ei\u0161ni uvjeti su uobi\u010dajeni<\/li>\n<\/ul>\n<p data-start=\"2741\" data-end=\"2849\">Ovakav definicija sprje\u010dava proizvoljne procjene i osigurava da vrijednost bude realna i utemeljena na tr\u017ei\u0161tu.<\/p>\n<h2 data-section-id=\"17tp8yu\" data-start=\"2856\" data-end=\"2898\">Tko mo\u017ee provoditi procjenu nekretnina?<\/h2>\n<p data-start=\"2900\" data-end=\"3002\">Zakon jasno propisuje da procjenu ne mo\u017ee raditi bilo koja osoba, ve\u0107 isklju\u010divo <b>ovla\u0161teni stru\u010dnjaci.<\/b><\/p>\n<p data-start=\"3004\" data-end=\"3027\">Procjenitelj mora biti:<\/p>\n<ul data-start=\"3029\" data-end=\"3112\">\n<li data-section-id=\"1bg61ru\" data-start=\"3029\" data-end=\"3077\">stalni sudski vje\u0161tak za procjenu nekretnina<\/li>\n<li data-section-id=\"1v0hbhn\" data-start=\"3078\" data-end=\"3112\">ili stalni sudski procjenitelj<\/li>\n<\/ul>\n<p data-start=\"3114\" data-end=\"3218\">Osim formalnih uvjeta, procjenitelj je du\u017ean postupati nepristrano i stru\u010dno. U praksi to zna\u010di da mora:<\/p>\n<ul data-start=\"3220\" data-end=\"3311\">\n<li data-section-id=\"cvw2p7\" data-start=\"3220\" data-end=\"3246\">izbje\u0107i sukob interesa<\/li>\n<li data-section-id=\"14fy0se\" data-start=\"3247\" data-end=\"3281\">koristiti provjerljive podatke<\/li>\n<li data-section-id=\"jbbc9x\" data-start=\"3282\" data-end=\"3311\">obrazlo\u017eiti sve zaklju\u010dke<\/li>\n<\/ul>\n<p data-start=\"3313\" data-end=\"3472\">Uz pojedina\u010dne procjenitelje, va\u017enu ulogu imaju i procjeniteljska povjerenstva, koja djeluju na lokalnoj i nacionalnoj razini te osiguravaju ujedna\u010denu praksu.<\/p>\n<h2 data-section-id=\"1j2bsdh\" data-start=\"3479\" data-end=\"3519\">Koje metode procjene propisuje Zakon o procjeni vrijednosti nekretnina?<\/h2>\n<p data-start=\"3521\" data-end=\"3629\">Zakon o procjeni vrijednosti nekretnina propisuje <b>tri osnovne metode procjene<\/b>, a izbor metode ovisi o vrsti nekretnine i dostupnosti podataka.<\/p>\n<h3 data-section-id=\"1ayk6z8\" data-start=\"3631\" data-end=\"3651\">Poredbena metoda<\/h3>\n<p data-start=\"3653\" data-end=\"3795\">Poredbena metoda naj\u010de\u0161\u0107e se koristi u praksi, osobito <b>kod stanova i ku\u0107a<\/b>. Temelji se na usporedbi sli\u010dnih nekretnina koje su nedavno prodane.<\/p>\n<p data-start=\"3797\" data-end=\"3849\">Da bi procjena bila pouzdana, potrebno je koristiti:<\/p>\n<ul data-start=\"3851\" data-end=\"3999\">\n<li data-section-id=\"gglfai\" data-start=\"3851\" data-end=\"3890\">najmanje tri usporedive transakcije<\/li>\n<li data-section-id=\"1hjfi62\" data-start=\"3891\" data-end=\"3918\">stvarne tr\u017ei\u0161ne podatke<\/li>\n<li data-section-id=\"h77xx6\" data-start=\"3919\" data-end=\"3999\">korekcije za razlike me\u0111u nekretninama<\/li>\n<\/ul>\n<h3 data-section-id=\"lmv1n2\" data-start=\"4006\" data-end=\"4027\">Prihodovna metoda<\/h3>\n<p data-start=\"4029\" data-end=\"4141\">Prihodovna metoda primjenjuje se kod <b>nekretnina koje generiraju prihod<\/b>, poput poslovnih prostora ili najamnih objekata.<\/p>\n<p data-start=\"4143\" data-end=\"4177\">Vrijednost se odre\u0111uje na temelju:<\/p>\n<ol>\n<li data-section-id=\"1pxxnjw\" data-start=\"4179\" data-end=\"4201\">o\u010dekivanih prihoda<\/li>\n<li data-section-id=\"1ym5jpj\" data-start=\"4202\" data-end=\"4225\">tro\u0161kova odr\u017eavanja<\/li>\n<li data-section-id=\"1nvgaja\" data-start=\"4226\" data-end=\"4251\">tr\u017ei\u0161ne stope prinosa<\/li>\n<\/ol>\n<h3 data-section-id=\"19qhm79\" data-start=\"4258\" data-end=\"4278\">Tro\u0161kovna metoda<\/h3>\n<p data-start=\"4280\" data-end=\"4382\">Tro\u0161kovna metoda koristi se <b>kada nema dovoljno tr\u017ei\u0161nih podataka<\/b>.<\/p>\n<p data-start=\"4384\" data-end=\"4398\">Temelji se na:<\/p>\n<ul data-start=\"4400\" data-end=\"4459\">\n<li data-section-id=\"p4m58c\" data-start=\"4400\" data-end=\"4420\">tro\u0161ku izgradnje<\/li>\n<li data-section-id=\"varb12\" data-start=\"4421\" data-end=\"4437\">amortizaciji<\/li>\n<li data-section-id=\"nzdw6o\" data-start=\"4438\" data-end=\"4459\">stanju nekretnine<\/li>\n<\/ul>\n<p data-start=\"4461\" data-end=\"4569\">Va\u017eno je naglasiti da se u pravilu koristi jedna glavna metoda, dok se druge koriste kao kontrola rezultata.<\/p>\n<h2 data-section-id=\"18dtml7\" data-start=\"4576\" data-end=\"4620\">Procjembeni elaborat kao klju\u010dni dokument<\/h2>\n<p data-start=\"4622\" data-end=\"4714\">Rezultat procjene nije samo broj, ve\u0107 detaljan dokument koji se naziva&nbsp;<a href=\"https:\/\/procjena.com.hr\/procjembeni-elaborat-propisani-oblik-i-sadrzaj\/\" target=\"_blank\" rel=\"noopener\">procjembeni elaborat<\/a>.<\/p>\n<p data-start=\"4716\" data-end=\"4741\">Elaborat mora sadr\u017eavati:<\/p>\n<ul data-start=\"4743\" data-end=\"4836\">\n<li data-section-id=\"nmynfm\" data-start=\"4743\" data-end=\"4762\">opis nekretnine<\/li>\n<li data-section-id=\"52f9e8\" data-start=\"4763\" data-end=\"4786\">primijenjenu metodu<\/li>\n<li data-section-id=\"ie8w6k\" data-start=\"4787\" data-end=\"4808\">kori\u0161tene podatke<\/li>\n<li data-section-id=\"j0a7xm\" data-start=\"4809\" data-end=\"4836\">zaklju\u010dak o vrijednosti<\/li>\n<\/ul>\n<p data-start=\"4838\" data-end=\"4955\">Zakon zahtijeva da svaki element procjene bude jasno obrazlo\u017een i provjerljiv<\/p>\n<p data-start=\"4957\" data-end=\"5001\">U praksi, ovaj dokument ima klju\u010dnu ulogu u:<\/p>\n<ul data-start=\"5003\" data-end=\"5075\">\n<li data-section-id=\"ks5a31\" data-start=\"5003\" data-end=\"5025\">sudskim postupcima<\/li>\n<li data-section-id=\"1tx5b43\" data-start=\"5026\" data-end=\"5051\">bankarskim procjenama<\/li>\n<li data-section-id=\"fb4r15\" data-start=\"5052\" data-end=\"5075\">upravnim postupcima<\/li>\n<\/ul>\n<h2 data-section-id=\"61m3pz\" data-start=\"5082\" data-end=\"5120\">Zakon o procjeni vrijednosti nekretnina: sustav eNekretnine i tr\u017ei\u0161ni podaci<\/h2>\n<p data-start=\"5122\" data-end=\"5294\">Jedna od najva\u017enijih komponenti zakona jest <b>informacijski sustav&nbsp;<\/b><a href=\"https:\/\/nekretnine.mgipu.hr\/\" target=\"_blank\" rel=\"noopener\">eNekretnine<\/a>. Rije\u010d je o centralnoj bazi podataka koja omogu\u0107uje realno i objektivno vrednovanje nekretnina.<\/p>\n<p data-start=\"5296\" data-end=\"5313\">Sustav uklju\u010duje:<\/p>\n<ul data-start=\"5315\" data-end=\"5398\">\n<li data-section-id=\"1e7g3qr\" data-start=\"5315\" data-end=\"5346\">zbirku kupoprodajnih cijena<\/li>\n<li data-section-id=\"78xyjz\" data-start=\"5347\" data-end=\"5378\">plan pribli\u017enih vrijednosti<\/li>\n<li data-section-id=\"1koz29l\" data-start=\"5379\" data-end=\"5398\">analize tr\u017ei\u0161ta<\/li>\n<\/ul>\n<p data-start=\"5400\" data-end=\"5539\">Ovi podaci omogu\u0107uju procjeniteljima da donose zaklju\u010dke na temelju stvarnih tr\u017ei\u0161nih kretanja, \u010dime se zna\u010dajno pove\u0107ava to\u010dnost procjena.<\/p>\n<h2 data-section-id=\"17ojlj5\" data-start=\"5546\" data-end=\"5581\">Procjena posebnih prava i tereta u Zakonu o procjeni vrijednosti nekretnina<\/h2>\n<p data-start=\"5583\" data-end=\"5665\">Zakon ne obuhva\u0107a samo nekretnine kao takve, ve\u0107 i prava koja su s njima povezana.<\/p>\n<p data-start=\"5667\" data-end=\"5680\">To uklju\u010duje:<\/p>\n<ul data-start=\"5682\" data-end=\"5759\">\n<li data-section-id=\"1hy9l6f\" data-start=\"5682\" data-end=\"5700\">pravo gra\u0111enja<\/li>\n<li data-section-id=\"o23woj\" data-start=\"5701\" data-end=\"5714\">slu\u017enosti<\/li>\n<li data-section-id=\"l7wxfe\" data-start=\"5715\" data-end=\"5738\">pravo plodou\u017eivanja<\/li>\n<li data-section-id=\"z96dt3\" data-start=\"5739\" data-end=\"5759\">pravo stanovanja<\/li>\n<\/ul>\n<p data-start=\"5761\" data-end=\"5867\">Vrijednost ovih prava odre\u0111uje se ovisno o njihovom utjecaju na nekretninu, trajanju i ekonomskoj koristi.<\/p>\n<h2 data-section-id=\"1vd4pzn\" data-start=\"5874\" data-end=\"5916\">Naj\u010de\u0161\u0107e pogre\u0161ke u procjeni nekretnina<\/h2>\n<p data-start=\"5918\" data-end=\"6012\">U praksi se \u010desto pojavljuju pogre\u0161ke koje mogu imati ozbiljne posljedice.
