Najpoznatije su zemlji\u0161ne knjige, koje predstavljaju temeljni registar vlasni\u0161tva i stvarnih prava. Me\u0111utim, u kontekstu ovr\u0161nih postupaka i prodaje imovine putem elektroni\u010dke dra\u017ebe, posebnu ulogu ima <b>o\u010devidnik nekretnina i pokretnina<\/b> koji vodi Financijska agencija (Fina).<\/p>\n<p data-start=\"644\" data-end=\"698\">Za razliku od zemlji\u0161nih knjiga, o\u010devidnik nekretnina nije registar vlasni\u0161tva te ne slu\u017ei za utvr\u0111ivanje tko je vlasnik nekretnine ve\u0107 prikazuje predmete prodaje u postupcima ovrhe i sudske prodaje.<\/p>\n<p data-start=\"855\" data-end=\"882\">U ovom vodi\u010du obja\u0161njavamo:<\/p>\n<ul data-start=\"884\" data-end=\"1036\">\n<li data-section-id=\"13nvyiu\" data-start=\"884\" data-end=\"915\">\u0161to je o\u010devidnik nekretnina<\/li>\n<li data-section-id=\"xvedqm\" data-start=\"916\" data-end=\"954\">kako funkcionira u okviru e-Dra\u017ebe<\/li>\n<li data-section-id=\"1dzy7ww\" data-start=\"955\" data-end=\"978\">koje podatke sadr\u017ei<\/li>\n<li data-section-id=\"aonric\" data-start=\"979\" data-end=\"1005\">tko mu mo\u017ee pristupiti<\/li>\n<li data-section-id=\"1cvs1m3\" data-start=\"1006\" data-end=\"1036\">kako ga koristiti u praksi<\/li>\n<\/ul>\n<hr data-start=\"1038\" data-end=\"1041\">\n<h2><strong>\u0160to je o\u010devidnik nekretnina?<\/strong><\/h2>\n<p data-start=\"1075\" data-end=\"1272\">O\u010devidnik nekretnina (to\u010dnije:<b>&nbsp;<\/b><a href=\"https:\/\/ponip.fina.hr\/ocevidnik-web\/\" target=\"_blank\" rel=\"noopener\">o\u010devidnik nekretnina i pokretnina<\/a>) je <b>elektroni\u010dka evidencija koju vodi Fina<\/b>, a koja sadr\u017ei podatke o predmetima prodaje u postupcima prisilne naplate, odnosno ovrhe.<\/p>\n<p data-start=\"1274\" data-end=\"1413\">Klju\u010dno je razumjeti da o\u010devidnik ne slu\u017ei za otkrivanje imovine du\u017enika, ve\u0107 za prikaz konkretnih predmeta koji su ve\u0107 u postupku prodaje.<\/p>\n<p data-start=\"1415\" data-end=\"1442\">Drugim rije\u010dima, o\u010devidnik prikazuje nekretnine koje se prodaju putem&nbsp;<a href=\"https:\/\/www.fina.hr\/javne-usluge\/e-drazba\" target=\"_blank\" rel=\"noopener\">e-Dra\u017ebe<\/a>.<\/p>\n<p data-start=\"1415\" data-end=\"1442\">Organiziran je po predmetima prodaje i slu\u017ei transparentnosti postupka.<\/p>\n<hr data-start=\"1578\" data-end=\"1581\">\n<h2><strong>O\u010devidnik nekretnina i Fina: uloga i pravni okvir<\/strong><\/h2>\n<p data-start=\"1634\" data-end=\"1753\">O\u010devidnik vodi&nbsp;<a href=\"https:\/\/www.fina.hr\/\" target=\"_blank\" rel=\"noopener\">Financijska agencija (Fina)<\/a>&nbsp;u elektroni\u010dkom obliku, kao dio sustava elektroni\u010dke javne dra\u017ebe.<\/p>\n<p data-start=\"1755\" data-end=\"1781\">Pravni okvir proizlazi iz&nbsp;<a href=\"https:\/\/www.zakon.hr\/z\/74\/ovrsni-zakon\" target=\"_blank\" rel=\"noopener\">Ovr\u0161nog zakona<\/a>&nbsp;te podzakonskih akata koji ure\u0111uju provedbu e-Dra\u017ebe.<\/p>\n<p data-start=\"1880\" data-end=\"1905\">Upis u o\u010devidnik vr\u0161i se:<\/p>\n<ul data-start=\"1907\" data-end=\"2056\">\n<li data-section-id=\"14gyzby\" data-start=\"1907\" data-end=\"1941\">na temelju zahtjeva za prodaju<\/li>\n<li data-section-id=\"1f50alv\" data-start=\"1942\" data-end=\"1985\">na temelju zahtjeva za upis u o\u010devidnik<\/li>\n<li data-section-id=\"1mg23k0\" data-start=\"1986\" data-end=\"2056\">od strane nadle\u017enih tijela (naj\u010de\u0161\u0107e sudova ili javnih bilje\u017enika)<\/li>\n<\/ul>\n<p data-start=\"2058\" data-end=\"2156\">Va\u017eno je naglasiti da <b>Fina ne odlu\u010duje o prodaji<\/b>, ve\u0107 administrativno vodi evidenciju i platformu.<\/p>\n<hr data-start=\"2158\" data-end=\"2161\">\n<h2><strong>O\u010devidnik nekretnina i ovrhe<\/strong><\/h2>\n<p data-start=\"2195\" data-end=\"2283\">O\u010devidnik nekretnina izravno je povezan s ovr\u0161nim postupkom, ali u fazi prodaje imovine.<\/p>\n<p data-start=\"2285\" data-end=\"2308\">Tipi\u010dan tijek postupka:<\/p>\n<ol data-start=\"2310\" data-end=\"2481\">\n<li data-section-id=\"zuwdr\" data-start=\"2310\" data-end=\"2331\">pokre\u0107e se ovrha<\/li>\n<li data-section-id=\"1ksmnyk\" data-start=\"2332\" data-end=\"2375\">sud donosi odluku o prodaji nekretnine<\/li>\n<li data-section-id=\"1dr94dh\" data-start=\"2376\" data-end=\"2406\">predmet se dostavlja Fini<\/li>\n<li data-section-id=\"1ihgt09\" data-start=\"2407\" data-end=\"2439\">Fina ga upisuje u o\u010devidnik<\/li>\n<li data-section-id=\"s11hqz\" data-start=\"2440\" data-end=\"2481\">nekretnina se prodaje putem e-Dra\u017ebe<\/li>\n<\/ol>\n<p data-start=\"2483\" data-end=\"2584\">O\u010devidnik stoga ne slu\u017ei za pronala\u017eenje imovine, ve\u0107 za provedbu prodaje ve\u0107 identificirane imovine.<\/p>\n<hr data-start=\"2586\" data-end=\"2589\">\n<h2><strong>Koji podaci se nalaze u o\u010devidniku nekretnina?<\/strong><\/h2>\n<p data-start=\"2641\" data-end=\"2774\">O\u010devidnik sadr\u017ei podatke organizirane po predmetu prodaje.
