Iako se \u010desto spominje u kontekstu stambenih kredita i kupoprodajnih ugovora, mnogi gra\u0111ani nisu u potpunosti svjesni \u0161to solemnizacija zapravo zna\u010di i kakve pravne posljedice ima.<\/p>\n<p data-start=\"631\" data-end=\"917\">Za razliku od obi\u010dne ovjere potpisa, solemnizacija predstavlja slo\u017eeniji pravni postupak u kojem javni bilje\u017enik ne samo da potvr\u0111uje identitet stranaka, ve\u0107 i provjerava sadr\u017eaj ugovora, upozorava stranke na pravne posljedice te potvr\u0111uje da su stranke razumjele ugovor koji potpisuju.<\/p>\n<p data-start=\"631\" data-end=\"917\">Nastavite \u010ditati i saznajte:<\/p>\n<ul data-start=\"1037\" data-end=\"1181\">\n<li data-section-id=\"76vfzj\" data-start=\"1037\" data-end=\"1069\">\u0161to je solemnizacija ugovora<\/li>\n<li data-section-id=\"ooksyr\" data-start=\"1070\" data-end=\"1089\">kada je obvezna<\/li>\n<li data-section-id=\"apmsv1\" data-start=\"1090\" data-end=\"1106\">koliko ko\u0161ta<\/li>\n<li data-section-id=\"lhpuuh\" data-start=\"1107\" data-end=\"1132\">kako izgleda postupak<\/li>\n<li data-section-id=\"12aay1r\" data-start=\"1133\" data-end=\"1162\">koje su pravne posljedice<\/li>\n<li data-section-id=\"vgq4ln\" data-start=\"1163\" data-end=\"1181\">koji su rizici<\/li>\n<\/ul>\n<div>\n<h2 data-section-id=\"1i6kpuw\" data-start=\"153\" data-end=\"176\">\u0160to je solemnizacija ugovora?<\/h2>\n<p data-start=\"178\" data-end=\"396\">Solemnizacija ugovora je <b>poseban pravni postupak koji provodi javni bilje\u017enik<\/b>. Njime<b>\u00a0<\/b>se <b>potvr\u0111uje ne samo identitet stranaka, ve\u0107 i sadr\u017eaj ugovora te njihova svijest o pravnim posljedicama koje iz ugovora proizlaze.<\/b><\/p>\n<p data-start=\"398\" data-end=\"502\">Za razliku od obi\u010dne ovjere potpisa, kod solemnizacije javni bilje\u017enik ima aktivniju ulogu. Du\u017ean je:<\/p>\n<ul data-start=\"504\" data-end=\"705\">\n<li data-section-id=\"1np5grq\" data-start=\"504\" data-end=\"545\">provjeriti identitet ugovornih strana<\/li>\n<li data-section-id=\"1i0fas\" data-start=\"546\" data-end=\"596\">pro\u010ditati ili omogu\u0107iti uvid u sadr\u017eaj ugovora<\/li>\n<li data-section-id=\"1wdng0o\" data-start=\"597\" data-end=\"651\">upozoriti stranke na pravne u\u010dinke i mogu\u0107e rizike<\/li>\n<li data-section-id=\"9ffu91\" data-start=\"652\" data-end=\"705\">potvrditi da je ugovor sklopljen slobodnom voljom<\/li>\n<\/ul>\n<p data-start=\"707\" data-end=\"788\">Pravni temelj za ovaj postupak nalazi se u\u00a0<a href=\"https:\/\/www.zakon.hr\/z\/188\/zakon-o-javnom-biljeznistvu\" target=\"_blank\" rel=\"noopener\">Zakonu o javnom bilje\u017eni\u0161tvu<\/a>.<\/p>\n<p data-start=\"790\" data-end=\"1020\">Najva\u017enija posljedica solemnizacije je da <b>takav ugovor mo\u017ee imati snagu ovr\u0161ne isprave.<\/b> To zna\u010di da vjerovnik u slu\u010daju neispunjenja obveze mo\u017ee pokrenuti ovr\u0161ni postupak bez prethodnog sudskog spora, \u0161to zna\u010dajno ubrzava naplatu.<\/p>\n<h2 data-section-id=\"1ch06yw\" data-start=\"1860\" data-end=\"1922\">Kada je solemnizacija ugovora obvezna, a kada preporu\u010dljiva?<\/h2>\n<p data-start=\"1924\" data-end=\"2010\"><b>Solemnizacija nije uvijek zakonski obvezna<\/b>, ali u odre\u0111enim situacijama postaje nu\u017ena.<\/p>\n<p data-start=\"2012\" data-end=\"2041\">Naj\u010de\u0161\u0107i slu\u010dajevi su <b>stambeni i drugi bankarski krediti<\/b> te <b>ugovori koji se \u017eele u\u010diniti ovr\u0161nima.<\/b><\/p>\n<p data-start=\"2125\" data-end=\"2217\">U drugim situacijama solemnizacija je dobrovoljna, ali preporu\u010dljiva zbog pravne sigurnosti.<\/p>\n<p data-start=\"2219\" data-end=\"2230\">Primjerice:<\/p>\n<ul data-start=\"2232\" data-end=\"2323\">\n<li data-section-id=\"s52475\" data-start=\"2232\" data-end=\"2262\">kod kupoprodaje nekretnine<\/li>\n<li data-section-id=\"d052m1\" data-start=\"2263\" data-end=\"2289\">kod dugoro\u010dnih ugovora<\/li>\n<li data-section-id=\"1w3rs6n\" data-start=\"2290\" data-end=\"2323\">kod ve\u0107ih financijskih obveza<\/li>\n<\/ul>\n<div>\n<h2 data-section-id=\"152rjtl\" data-start=\"4772\" data-end=\"4813\">Koji ugovori se naj\u010de\u0161\u0107e solemniziraju?<\/h2>\n<p data-start=\"4815\" data-end=\"4841\">Naj\u010de\u0161\u0107e se solemniziraju:<\/p>\n<ul data-start=\"4843\" data-end=\"4909\">\n<li data-section-id=\"1a6fgx4\" data-start=\"4843\" data-end=\"4864\">ugovori o kreditu<\/li>\n<li data-section-id=\"1f80gdv\" data-start=\"4865\" data-end=\"4889\">kupoprodajni ugovori<\/li>\n<li data-section-id=\"1hujig5\" data-start=\"4890\" data-end=\"4909\">ugovori o najmu<\/li>\n<\/ul>\n<p data-start=\"4911\" data-end=\"4956\">Razlog tome je pravna sigurnost i mogu\u0107nost ovrhe.<\/p>\n<\/div>\n<div>\n<h2 data-section-id=\"18sk2rr\" data-start=\"2656\" data-end=\"2679\">Solemnizacija kredita<\/h2>\n<p data-start=\"2681\" data-end=\"2855\">Solemnizacija ugovora o kreditu standardna je praksa u bankarskom poslovanju.\u00a0<b>Gotovo uvijek predstavlja uvjet za isplatu kredita<\/b>, osobito kada se radi o stambenim kreditima.<\/p>\n<p data-start=\"2857\" data-end=\"3059\">Razlog za to le\u017ei u \u010dinjenici da <b>solemnizirani ugovor postaje ovr\u0161na isprava<\/b>. To zna\u010di da banka, u slu\u010daju nepla\u0107anja obveza, mo\u017ee pokrenuti ovr\u0161ni postupak bez potrebe za dugotrajnim sudskim postupkom.<\/p>\n<p data-start=\"3061\" data-end=\"3305\">Za korisnika kredita to ima zna\u010dajne posljedice. S jedne strane, <b>solemnizacija osigurava pravnu jasno\u0107u ugovora<\/b> i potvrdu da su svi uvjeti poznati i razumljivi. S druge strane, ona nosi i odre\u0111eni rizik jer <b>omogu\u0107uje br\u017eu prisilnu naplatu duga.<\/b><\/p>\n<p data-start=\"3307\" data-end=\"3465\">Zbog toga je posebno va\u017eno prije solemnizacije pa\u017eljivo <b>prou\u010diti sve odredbe ugovora<\/b>, uklju\u010duju\u0107i kamatne stope, rokove otplate i eventualne dodatne tro\u0161kove.<\/p>\n<h2 data-section-id=\"1l9gwnl\" data-start=\"3472\" data-end=\"3509\">Solemnizacija kupoprodajnog ugovora<\/h2>\n<p data-start=\"3511\" data-end=\"3688\">Solemnizacija kupoprodajnog ugovora o nekretnini nije uvijek zakonski obvezna, ali se \u010desto koristi kao <b>dodatni sloj pravne sigurnosti<\/b>, osobito kod transakcija ve\u0107e vrijednosti.<\/p>\n<p data-start=\"3690\" data-end=\"3724\">U praksi, solemnizacija omogu\u0107uje:<\/p>\n<ol>\n<li data-section-id=\"omv41c\" data-start=\"3726\" data-end=\"3782\">dodatnu kontrolu ugovora od strane javnog bilje\u017enika<\/li>\n<li data-section-id=\"13xkyot\" data-start=\"3783\" data-end=\"3826\">smanjenje rizika od pravnih nedostataka<\/li>\n<li data-section-id=\"7a3b6o\" data-start=\"3827\" data-end=\"3866\">ja\u010du pravnu za\u0161titu u slu\u010daju spora<\/li>\n<\/ol>\n<p data-start=\"3868\" data-end=\"4033\">Osim toga, u odre\u0111enim situacijama mo\u017ee se koristiti kako bi se <b>osiguralo izvr\u0161enje obveza iz ugovora<\/b>, primjerice isplata kupoprodajne cijene ili predaja nekretnine.<\/p>\n<p data-start=\"4035\" data-end=\"4176\">Iako nije nu\u017ena u svakom slu\u010daju, solemnizacija kupoprodajnog ugovora \u010desto se preporu\u010duje kada postoji pove\u0107an pravni ili financijski rizik.<\/p>\n<h2 data-section-id=\"q6tc2u\" data-start=\"4183\" data-end=\"4214\">Solemnizacija ugovora o najmu<\/h2>\n<p data-start=\"4216\" data-end=\"4367\">Solemnizacija ugovora o najmu naj\u010de\u0161\u0107e se koristi kao <b>sredstvo za\u0161tite najmodavca<\/b>, osobito kod dugoro\u010dnih najamnih odnosa ili najma poslovnih prostora.<\/p>\n<p data-start=\"4369\" data-end=\"4553\">Ako je ugovor o najmu solemniziran, <b>najmodavac mo\u017ee u odre\u0111enim situacijama br\u017ee ostvariti svoja prava<\/b>, primjerice u slu\u010daju nepla\u0107anja najamnine ili potrebe za iseljenjem najmoprimca.<\/p>\n<p data-start=\"4555\" data-end=\"4648\">To zna\u010di da se <b>izbjegava dugotrajan sudski postupak<\/b>, \u0161to je u praksi \u010desto presudna prednost.<\/p>\n<p data-start=\"4650\" data-end=\"4817\">S druge strane, i najmoprimac ima korist od jasno definiranih prava i obveza, budu\u0107i da solemnizacija osigurava da su uvjeti ugovora pravno provjereni i transparentni.<\/p>\n<p data-start=\"4819\" data-end=\"4960\">Zbog toga solemnizacija ugovora o najmu mo\u017ee biti korisna za obje strane, osobito kada se radi o pravno ili financijski zna\u010dajnijim odnosima.<\/p>\n<h2 data-section-id=\"1qu4a3a\" data-start=\"3505\" data-end=\"3552\">Razlika izme\u0111u ovjere potpisa i solemnizacije<\/h2>\n<p data-start=\"3554\" data-end=\"3626\">Jedna od naj\u010de\u0161\u0107ih zabluda odnosi se na razliku izme\u0111u ova dva postupka.<\/p>\n<p data-start=\"3628\" data-end=\"3643\">Ovjera potpisa <b>potvr\u0111uje identitet potpisnika<\/b> te <b>ne provjerava sadr\u017eaj<\/b>.<\/p>\n<p data-start=\"3707\" data-end=\"3721\">Solemnizacija <b>provjerava sadr\u017eaj ugovora<\/b>, <b>upozorava na pravne posljedice<\/b> te <b>daje ugovoru ja\u010du pravnu snagu<\/b>.<\/p>\n<h2 data-section-id=\"1226a93\" data-start=\"3830\" data-end=\"3862\">Postupak solemnizacije ugovora<\/h2>\n<p data-start=\"3864\" data-end=\"3919\">Postupak solemnizacije odvija se kod javnog bilje\u017enika.<\/p>\n<p data-start=\"3921\" data-end=\"3931\">Uklju\u010duje:<\/p>\n<ol>\n<li data-section-id=\"1maw7xx\" data-start=\"3933\" data-end=\"3965\">provjeru identiteta stranaka<\/li>\n<li data-section-id=\"10jovn6\" data-start=\"3966\" data-end=\"3985\">pregled ugovora<\/li>\n<li data-section-id=\"ie655y\" data-start=\"3986\" data-end=\"4020\">\u010ditanje i obja\u0161njenje sadr\u017eaja<\/li>\n<li data-section-id=\"1tr3qac\" data-start=\"4021\" data-end=\"4056\">upozorenje na pravne posljedice<\/li>\n<li data-section-id=\"1og2za9\" data-start=\"4057\" data-end=\"4081\">potpisivanje ugovora<\/li>\n<\/ol>\n<p data-start=\"4083\" data-end=\"4146\">Bilje\u017enik je du\u017ean osigurati da stranke razumiju \u0161to potpisuju.<\/p>\n<h2><strong style=\"font-family: Inter, playfair; font-size: 18px; text-align: right;\">\u00a0<\/strong>Solemnizacija ugovora &#8211; cijena<\/h2>\n<p data-start=\"1059\" data-end=\"1328\">Cijena solemnizacije ugovora odre\u0111uje se prema vrijednosti pravnog posla i regulirana je propisima koji ure\u0111uju javnobilje\u017eni\u010dke usluge.\u00a0<\/p>\n<p data-start=\"1059\" data-end=\"1328\">U pravilu se radi o <b>tarifnom sustavu<\/b>, \u0161to zna\u010di da javni bilje\u017enik ne odre\u0111uje cijenu proizvoljno, ve\u0107 u skladu s va\u017ee\u0107im pravilima.<\/p>\n<p data-start=\"1330\" data-end=\"1616\">Kod ugovora manje vrijednosti, tro\u0161ak solemnizacije mo\u017ee biti relativno nizak i iznositi nekoliko desetaka eura.
