U praksi se naj\u010de\u0161\u0107e koristi kada kupac \u010deka odobrenje kredita, kada dokumentacija nekretnine nije u potpunosti ure\u0111ena ili kada strane \u017eele rezervirati nekretninu uz odre\u0111ene uvjete.<\/p>\n<p data-start=\"759\" data-end=\"1028\">Iako se \u010desto do\u017eivljava kao \u201cprivremeni\u201d ili \u201cmanje va\u017ean\u201d ugovor, predugovor ima ozbiljne pravne u\u010dinke. Njime se obje strane obvezuju da \u0107e u budu\u0107nosti sklopiti glavni kupoprodajni ugovor, a njegovo kr\u0161enje mo\u017ee dovesti do sudskih sporova i financijskih posljedica.<\/p>\n<p data-start=\"1030\" data-end=\"1070\">Pravni temelj za predugovor nalazi se u&nbsp;<a href=\"https:\/\/www.zakon.hr\/z\/75\/zakon-o-obveznim-odnosima\" target=\"_blank\" rel=\"noopener\">Zakonu o data-end=\"2264\">mo\u017ee se sudski prisiliti izvr\u0161enje<\/li>\n<\/ul>\n<p data-start=\"2266\" data-end=\"2350\">To zna\u010di da predugovor nije samo neformalni dogovor, ve\u0107 pravno obvezuju\u0107i dokument.<\/p>\n<hr data-start=\"2352\" data-end=\"2355\">\n<h2 data-section-id=\"1cmzikz\" data-start=\"2357\" data-end=\"2421\">Predugovor o kupoprodaji nekretnine: kada se koristi u praksi?<\/h2>\n<p data-start=\"2423\" data-end=\"2484\">U praksi se predugovor koristi u nekoliko tipi\u010dnih situacija.<\/p>\n<p data-start=\"2486\" data-end=\"2513\">Naj\u010de\u0161\u0107i razlozi uklju\u010duju:<\/p>\n<ul data-start=\"2515\" data-end=\"2703\">\n<li data-section-id=\"r9cgew\" data-start=\"2515\" data-end=\"2557\">kupac \u010deka odobrenje stambenog kredita<\/li>\n<li data-start=\"2705\" data-end=\"2726\">Predugovor omogu\u0107uje <b>definiranje rokova<\/b>, <b>za\u0161titu interesa obje strane <\/b>te <b>smanjenje rizika<\/b>.<\/p>\n<hr data-start=\"2806\" data-end=\"2809\">\n<h2 data-section-id=\"15tli7s\" data-start=\"2811\" data-end=\"2857\">Predugovor o kupoprodaji nekretnine &#8211; kapara<\/h2>\n<p data-start=\"2859\" data-end=\"2909\"><b>Kapara je jedan od klju\u010dnih elemenata predugovora.<\/b><\/p>\n<p data-start=\"2911\" data-end=\"3005\">Radi se o nov\u010danom iznosu koji kupac daje prodavatelju kao potvrdu ozbiljnosti namjere kupnje.<\/p>\n<p data-start=\"3007\" data-end=\"3040\">Kapara ima va\u017enu pravnu funkciju:<\/p>\n<ul data-start=\"3042\" data-end=\"3139\">\n<li data-section-id=\"oxfj51\" data-start=\"3042\" kaparu<\/li>\n<\/ul>\n<p data-start=\"3141\" data-end=\"3226\">Ova pravila proizlaze iz op\u0107ih na\u010dela&nbsp;<a href=\"https:\/\/www.enciklopedija.hr\/clanak\/obvezno-pravo\" target=\"_blank\" rel=\"noopener\">obveznog prava<\/a>&nbsp;i slu\u017ee kao za\u0161tita za obje strane.<\/p>\n<hr data-start=\"3228\" data-end=\"3231\">\n<h2 data-section-id=\"10t237e\" data-start=\"3233\" data-end=\"3279\">Predugovor o kupoprodaji nekretnine &#8211; cijena<\/h2>\n<p data-start=\"3281\" data-end=\"3329\">Cijena je jedan od bitnih elemenata predugovora o kupoprodaji nekretnine.<\/p>\n<p data-start=\"3331\" data-end=\"3341\">U pravilu:<\/p>\n<ul data-start=\"3343\" data-end=\"3415\">\n<li data-section-id=\"41kjnf\" data-start=\"3343\" data-end=\"3378\">cijena mora biti jasno
