Roditelji daruju stan djeci, supru\u017enici ure\u0111uju imovinske odnose, a nekretnine se \u010desto prenose i me\u0111u drugim \u010dlanovima obitelji bez naknade.<\/p>\n<p data-start=\"561\" data-end=\"726\">Iako se na prvi pogled \u010dini jednostavnim, darovni ugovor nosi niz pravnih, poreznih i nasljednopravnih posljedica koje je potrebno razumjeti prije njegova sklapanja.<\/p>\n<p data-start=\"728\" data-end=\"980\">U ovom vodi\u010du \u0107ete saznati:<\/p>\n<ul>\n<li>\u0161to je darovni ugovor za nekretninu<\/li>\n<li>kada se koristi<\/li>\n<li>kako se sklapa<\/li>\n<li>kako se prenosi vlasni\u0161tvo<\/li>\n<li>koliki su porezi i tro\u0161kovi<\/li>\n<li>mo\u017ee li se darovni ugovor opozvati<\/li>\n<li>koji su pravni rizici darovanja nekretnine<\/li>\n<\/ul>\n<h2 data-section-id=\"frmpqu\" data-start=\"1237\" data-end=\"1275\">\u0160to je darovni ugovor za nekretninu?<\/h2>\n<p data-start=\"1277\" data-end=\"1415\">Darovni ugovor je <b>ugovor kojim jedna osoba, darovatelj, bez naknade prenosi vlasni\u0161tvo odre\u0111ene nekretnine na drugu osobu, daroprimatelja.<\/b><\/p>\n<p data-start=\"1417\" data-end=\"1602\">Za razliku od kupoprodajnog ugovora, kod<b> darovanja ne postoji protu\u010dinidba<\/b>. Drugim rije\u010dima, daroprimatelj ne pla\u0107a kupoprodajnu cijenu niti daje bilo kakvu drugu naknadu za nekretninu.<\/p>\n<p data-start=\"1604\" data-end=\"1729\">U pravnom smislu, darovanje predstavlja jednostrano imovinsko raspolaganje koje ima za posljedicu trajni prijenos vlasni\u0161tva.<\/p>\n<p data-start=\"1731\" data-end=\"1923\">Va\u017eno je naglasiti da se darovni ugovor za nekretninu razlikuje od darovanja pokretnih stvari jer uklju\u010duje dodatne formalnosti i pravne posljedice, osobito u vezi s upisom u zemlji\u0161ne knjige.<\/p>\n<hr data-start=\"1925\" data-end=\"1928\">\n<h2 data-section-id=\"pctzrt\" data-start=\"1930\" data-end=\"1966\">Koji zakon ure\u0111uje darovni ugovor za nekretninu?<\/h2>\n<p data-start=\"1968\" data-end=\"2056\">Darovni ugovor ure\u0111uje vi\u0161e propisa koji zajedno \u010dine pravni okvir darovanja nekretnine.<\/p>\n<p data-start=\"2058\" data-end=\"2231\">Osnovni zakon koji ure\u0111uje darovanje jest&nbsp;<a href=\"https:\/\/www.zakon.hr\/z\/75\/zakon-o-obveznim-odnosima\" target=\"_blank\" rel=\"noopener\">Zakon o obveznim odnosima<\/a>. Ovaj zakon definira pravila darovanja, uvjete valjanosti ugovora te mogu\u0107nosti opoziva dara.<\/p>\n<p data-start=\"2233\" data-end=\"2404\">Prijenos vlasni\u0161tva nad nekretninom ure\u0111en je&nbsp;<a href=\"https:\/\/www.zakon.hr\/z\/103\/zakon-o-zemljisnim-knjigama\" target=\"_blank\" rel=\"noopener\">Zakonom o zemlji\u0161nim knjigama<\/a>. Prema ovom zakonu, vlasni\u0161tvo nad nekretninom stje\u010de se tek upisom u zemlji\u0161ne knjige.<\/p>\n<p data-start=\"2406\" data-end=\"2498\">To zna\u010di da potpisivanje darovnog ugovora samo po sebi <b>nije dovoljno<\/b> <b>za prijenos vlasni\u0161tva<\/b>.<\/p>\n<hr data-start=\"2500\" data-end=\"2503\">\n<h2 data-section-id=\"rblvij\" data-start=\"2505\" data-end=\"2565\">Mora li darovni ugovor za nekretninu biti ovjeren kod javnog bilje\u017enika?<\/h2>\n<p data-start=\"2567\" data-end=\"2697\">Darovni ugovor za nekretninu mora biti sastavljen <b>u pisanom obliku<\/b>, a potpisi stranaka moraju biti <b>ovjereni kod javnog bilje\u017enika.<\/b><\/p>\n<p data-start=\"2699\" data-end=\"2774\">Bez ovjere potpisa nije mogu\u0107e provesti upis vlasni\u0161tva u zemlji\u0161ne knjige.<\/p>\n<p data-start=\"2776\" data-end=\"2892\">U praksi se \u010desto koristi i&nbsp;<a href=\"https:\/\/lawyerincroatia.com\/solemnizacija-ugovora\/\" target=\"_blank\">solemnizacija ugovora<\/a>, kojom javni bilje\u017enik dodatno potvr\u0111uje pravnu valjanost ugovora.<\/p>\n<p data-start=\"2894\" data-end=\"2915\">Ova razlika je va\u017ena, jer <b>ovjera potpisa potvr\u0111uje identitet stranaka<\/b>, a <b>solemnizacija potvr\u0111uje pravnu sigurnost ugovora.<\/b><\/p>\n<hr data-start=\"3016\" data-end=\"3019\">\n<h2 data-section-id=\"uic6ac\" data-start=\"3021\" data-end=\"3065\">Kako izgleda darovni ugovor za nekretninu?<\/h2>\n<p data-start=\"3067\" data-end=\"3172\">Darovni ugovor mora sadr\u017eavati odre\u0111ene klju\u010dne elemente kako bi bio pravno valjan i primjenjiv u praksi.<\/p>\n<p data-start=\"3174\" data-end=\"3194\">U pravilu uklju\u010duje:<\/p>\n<ol>\n<li data-start=\"3196\" data-end=\"3236\">podatke o darovatelju i daroprimatelju<\/li>\n<li data-start=\"3238\" data-end=\"3261\">to\u010dan opis nekretnine<\/li>\n<li data-start=\"3263\" data-end=\"3295\">izjavu darovatelja o darovanju<\/li>\n<li data-start=\"3297\" data-end=\"3339\">izjavu daroprimatelja o prihva\u0107anju dara<\/li>\n<li data-start=\"3341\" data-end=\"3368\">zemlji\u0161noknji\u017enu klauzulu<\/li>\n<\/ol>\n<p data-start=\"3370\" data-end=\"3462\"><a style=\"background-color: #ffffff;\" href=\"https:\/\/savjetnik.hr\/clausula-intabulandi\/\" target=\"_blank\" rel=\"noopener\">Zemlji\u0161noknji\u017ena klauzula<\/a>&nbsp;posebno je va\u017ena jer omogu\u0107uje upis vlasni\u0161tva u zemlji\u0161ne knjige.&nbsp;<\/p>\n<p data-start=\"3370\" data-end=\"3462\">Bez nje daroprimatelj ne\u0107e mo\u0107i postati vlasnik nekretnine.<\/p>\n<h2 data-section-id=\"sh5ixw\" data-start=\"3530\" data-end=\"3582\">Kako se prenosi vlasni\u0161tvo nakon darovnog ugovora?<\/h2>\n<p data-start=\"3584\" data-end=\"3661\"><b>Prijenos vlasni\u0161tva nad nekretninom ne doga\u0111a se samim potpisivanjem ugovora.<\/b><\/p>\n<p data-start=\"3663\" data-end=\"3708\">Nakon sklapanja darovnog ugovora potrebno je:<\/p>\n<ul>\n<li data-start=\"3710\" data-end=\"3758\"><b>podnijeti prijedlog<\/b> za upis u zemlji\u0161ne knjige<\/li>\n<li data-start=\"3760\" data-end=\"3803\"><b>dostaviti ugovor i potrebnu dokumentaciju<\/b><\/li>\n<li data-start=\"3805\" data-end=\"3843\"><b>\u010dekati odluku<\/b> zemlji\u0161noknji\u017enog suda<\/li>\n<\/ul>\n<p data-start=\"3845\" data-end=\"3917\">Tek nakon \u0161to sud odobri upis, daroprimatelj postaje vlasnik nekretnine. Ovaj postupak provodi se sukladno <span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">Zakonu o zemlji\u0161nim knjigama<\/span><\/span>.<\/p>\n<h2 data-section-id=\"1teo7xv\" data-start=\"3998\" data-end=\"4048\">Koliki je porez na darovni ugovor za nekretninu?<\/h2>\n<p data-start=\"4050\" data-end=\"4119\">Darovanje nekretnine u pravilu podlije\u017ee&nbsp;<a href=\"https:\/\/gov.hr\/hr\/porez-na-promet-nekretnina\/1464\" target=\"_blank\" rel=\"noopener\">porezu na promet nekretnina<\/a>.<\/p>\n<p data-start=\"4050\" data-end=\"4119\">Porezna stopa iznosi <b>3% tr\u017ei\u0161ne vrijednosti nekretnine<\/b>.<\/p>\n<p data-start=\"4178\" data-end=\"4240\">Ova obveza proizlazi iz <span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">Zakona o porezu na promet nekretnina<\/span><\/span>. <strong>Porezni obveznik je daroprimatelj<\/strong>, odnosno osoba koja prima nekretninu.<\/p>\n<h3 data-section-id=\"1phmyde\" data-start=\"4320\" data-end=\"4345\">Kada se ovaj porez ne pla\u0107a?<\/h3>\n<p data-start=\"4347\" data-end=\"4393\">Zakon predvi\u0111a odre\u0111ena oslobo\u0111enja od&nbsp;<a href=\"https:\/\/lawyerincroatia.com\/porez-na-darovanje-nekretnine\/\" target=\"_blank\" rel=\"noopener\">poreznih nameta na darovanje nekretnine<\/a>.<\/p>\n<p data-start=\"4395\" data-end=\"4479\"><strong>Porez se ne pla\u0107a kada se nekretnina daruje izme\u0111u \u010dlanova u\u017ee obitelji<\/strong>, primjerice roditelja i djece, supru\u017enika te bra\u010dnih i izvanbra\u010dnih partnera.<\/p>\n<p data-start=\"4551\" data-end=\"4644\">U drugim slu\u010dajevima, primjerice kod darovanja izme\u0111u bra\u0107e ili drugih osoba, porez se pla\u0107a.<\/p>\n<h2 data-section-id=\"18hzq18\" data-start=\"4651\" data-end=\"4688\">Mo\u017ee li se darovni ugovor za nekretninu opozvati?<\/h2>\n<p data-start=\"4690\" data-end=\"4725\"><b>Darovni ugovor nije uvijek kona\u010dan.<\/b><\/p>\n<p data-start=\"4727\" data-end=\"4825\">Prema <span stanja darovatelja.<\/p>\n<p data-start=\"4945\" data-end=\"5013\"><b>Opoziv darovanja nije automatski<\/b> i <b>obi\u010dno zahtijeva sudski postupak<\/b>.<\/p>\n<h2 data-section-id=\"nukm0l\" data-start=\"5020\" data-end=\"5050\">Darovni ugovor za nekretninu i nasljedstvo<\/h2>\n<p data-start=\"5052\" data-end=\"5121\">Darovanje nekretnine mo\u017ee imati zna\u010dajan utjecaj na nasljedne imovine<\/b> me\u0111u nasljednicima, <b>pravo na nu\u017eni dio<\/b> i <b>mogu\u0107nost osporavanja darovanja<\/b>.<\/p>\n<p data-start=\"5344\" data-end=\"5423\">U praksi su sporovi oko darovanja \u010desti, osobito kada postoji vi\u0161e nasljednika.<\/p>\n<h2 data-section-id=\"1dl4939\" data-start=\"5430\" data-end=\"5464\">Koji su rizici darovnog ugovora?<\/h2>\n<p data-start=\"5466\"
