Jedna od najva\u017enijih obveza za vlasnike nekretnina jest <strong data-start=\"601\" data-end=\"644\">pravodobna prijava poreza na nekretnine<\/strong>&nbsp;nadle\u017enim poreznim tijelima.<\/p>\n<p data-start=\"675\" data-end=\"992\">Porezna prijava predstavlja formalni postupak kojim porezni obveznik obavje\u0161tava nadle\u017ena tijela o nastanku porezne obveze povezane s nekretninom. U ve\u0107ini slu\u010dajeva prijava se odnosi na <strong data-start=\"862\" data-end=\"892\">porez na promet nekretnina<\/strong>, ali mo\u017ee biti povezana i s drugim porezima, primjerice kod darovanja ili naslje\u0111ivanja nekretnine.<\/p>\n<p data-start=\"994\" data-end=\"1094\">U ovom vodi\u010du obja\u0161njavamo:<\/p>\n<ul data-start=\"1252\" data-end=\"1497\">\n<li data-section-id=\"1vrfydz\" data-start=\"1252\" data-end=\"1294\">\n<p data-start=\"1254\" data-end=\"1294\">\u0161to zna\u010di prijava poreza na nekretnine<\/p>\n<\/li>\n<li data-section-id=\"1n17vif\" data-start=\"1295\" data-end=\"1331\">\n<p data-start=\"1297\" data-end=\"1331\">kada je potrebno prijaviti porez<\/p>\n<\/li>\n<li data-section-id=\"1keoult\" data-start=\"1332\" data-end=\"1368\">\n<p data-start=\"1334\" data-end=\"1368\">tko je obvezan podnijeti prijavu<\/p>\n<\/li>\n<li data-section-id=\"1yhvgbm\" data-start=\"1369\" data-end=\"1403\">\n<p data-start=\"1371\" data-end=\"1403\">gdje i kako se prijava podnosi<\/p>\n<\/li>\n<li data-section-id=\"yyd05z\" data-start=\"1404\" data-end=\"1433\">\n<p data-start=\"1406\" data-end=\"1433\">koji su rokovi za prijavu<\/p>\n<\/li>\n<li data-section-id=\"7i55wt\" data-start=\"1434\" data-end=\"1497\">\n<p data-start=\"1436\" data-end=\"1497\">koje su mogu\u0107e posljedice ako se porez ne prijavi na vrijeme.<\/p>\n<\/li>\n<\/ul>\n<h2 data-section-id=\"pvt953\" data-start=\"1504\" data-end=\"1545\">\u0160to zna\u010di prijava poreza na nekretnine?<\/h2>\n<p data-start=\"1547\" data-end=\"1735\">Prijava poreza na nekretnine je postupak kojim porezni obveznik nadle\u017enom tijelu prijavljuje <strong data-start=\"1640\" data-end=\"1698\">stjecanje ili promjenu vezanu uz vlasni\u0161tvo nekretnine<\/strong> koja mo\u017ee uzrokovati poreznu obvezu.<\/p>\n<p data-start=\"1737\" data-end=\"1882\">Drugim rije\u010dima, kada osoba stekne nekretninu ili na neki na\u010din promijeni svoj pravni odnos prema nekretnini, mo\u017ee nastati obveza prijave poreza.<\/p>\n<p data-start=\"1884\" data-end=\"1930\">Porezna prijava omogu\u0107uje nadle\u017enom tijelu da:<\/p>\n<ul data-start=\"1932\" data-end=\"2030\">\n<li data-section-id=\"18wc1c9\" data-start=\"1932\" data-end=\"1968\">\n<p data-start=\"1934\" data-end=\"1968\">utvrdi <b>postoji li porezna obveza<\/b><\/p>\n<\/li>\n<li data-section-id=\"1lb4b5e\" data-start=\"1969\" data-end=\"1992\">\n<p data-start=\"1971\" data-end=\"1992\">utvrdi <b>iznos poreza<\/b><\/p>\n<\/li>\n<li data-section-id=\"1yi8q8x\" data-start=\"1993\" data-end=\"2030\">\n<p data-start=\"1995\" data-end=\"2030\">izda odgovaraju\u0107e <b>porezno rje\u0161enje<\/b>.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2032\" data-end=\"2149\">U Hrvatskoj postupak provodi&nbsp;<a href=\"https:\/\/porezna-uprava.gov.hr\/\" target=\"_blank\" rel=\"noopener\">Porezna uprava<\/a>, koja djeluje u okviru&nbsp;<a href=\"https:\/\/mfin.gov.hr\/\" target=\"_blank\" rel=\"noopener\">Ministarstva financija<\/a>.<\/p>\n<p data-start=\"2151\" data-end=\"2408\">Bitno je da znate da prijava poreza ne zna\u010di automatski da \u0107e porez biti napla\u0107en. U odre\u0111enim slu\u010dajevima zakon predvi\u0111a <strong data-start=\"2274\" data-end=\"2299\">oslobo\u0111enje od poreza<\/strong>, ali je prijava \u010desto i dalje potrebna kako bi porezno tijelo moglo provjeriti okolnosti konkretnog slu\u010daja.<\/p>\n<h2 data-section-id=\"1s9n4zq\" data-start=\"2415\" data-end=\"2464\">Kada je potrebno prijaviti porez na nekretnine?<\/h2>\n<p data-start=\"2466\" data-end=\"2597\">Prijava poreza na nekretnine potrebna je u razli\u010ditim situacijama koje uklju\u010duju stjecanje ili prijenos vlasni\u0161tva nad nekretninom.<\/p>\n<p data-start=\"2599\" data-end=\"2628\">Naj\u010de\u0161\u0107e situacije uklju\u010duju:<\/p>\n<ul data-start=\"2630\" data-end=\"2742\">\n<li data-section-id=\"1hev55k\" data-start=\"2630\" data-end=\"2651\">\n<p data-start=\"2632\" data-end=\"2651\">kupnju nekretnine<\/p>\n<\/li>\n<li data-section-id=\"1e114nd\" data-start=\"2652\" data-end=\"2676\">\n<p data-start=\"2654\" data-end=\"2676\">darovanje nekretnine<\/p>\n<\/li>\n<li data-section-id=\"1ps6cqe\" data-start=\"2677\" data-end=\"2705\">\n<p data-start=\"2679\" data-end=\"2705\">naslje\u0111ivanje nekretnine<\/p>\n<\/li>\n<li data-section-id=\"6iawcb\" data-start=\"2706\" data-end=\"2742\">\n<p data-start=\"2708\" data-end=\"2742\">druge oblike prijenosa vlasni\u0161tva.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2744\" data-end=\"2808\">Svaka od ovih situacija mo\u017ee imati razli\u010dite porezne posljedice.<\/p>\n<h2 data-section-id=\"y57i2q\" data-start=\"2815\" data-end=\"2853\">Prijava poreza kod kupnje nekretnine<\/h2>\n<p data-start=\"2855\" data-end=\"2946\">Jedna od naj\u010de\u0161\u0107ih situacija u kojoj se podnosi porezna prijava jest <strong data-start=\"2924\" data-end=\"2945\">kupnja nekretnine<\/strong>.<\/p>\n<p data-start=\"2948\" data-end=\"3088\">U tom slu\u010daju naj\u010de\u0161\u0107e nastaje obveza pla\u0107anja <strong data-start=\"2995\" data-end=\"3026\">poreza na promet nekretnina<\/strong>, koji je reguliran <strong data-start=\"3046\" data-end=\"3087\"><span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">Zakon o porezu na promet nekretnina<\/span><\/span><\/strong>.<\/p>\n<p data-start=\"3090\" data-end=\"3166\">Porez na promet nekretnina iznosi <strong data-start=\"3124\" data-end=\"3165\">3 % od tr\u017ei\u0161ne vrijednosti nekretnine<\/strong>.<\/p>\n<p data-start=\"3168\" data-end=\"3307\">Nakon sklapanja kupoprodajnog ugovora, podaci o transakciji dostavljaju se poreznoj upravi, koja zatim provodi postupak utvr\u0111ivanja poreza.<\/p>\n<p data-start=\"3309\" data-end=\"3348\">U praksi to zna\u010di da \u0107e porezna uprava:<\/p>\n<ol data-start=\"3350\" data-end=\"3497\">\n<li data-section-id=\"13exycl\" data-start=\"3350\" data-end=\"3392\">\n<p data-start=\"3353\" data-end=\"3392\">zaprimiti dokumentaciju o kupoprodaji<\/p>\n<\/li>\n<li data-section-id=\"19cfamc\" data-start=\"3393\" data-end=\"3430\">\n<p data-start=\"3396\" data-end=\"3430\">provjeriti vrijednost nekretnine<\/p>\n<\/li>\n<li data-section-id=\"verc5p\" data-start=\"3431\" data-end=\"3461\">\n<p data-start=\"3434\" data-end=\"3461\">donijeti porezno rje\u0161enje<\/p>\n<\/li>\n<li data-section-id=\"1dt2zw9\" data-start=\"3462\" data-end=\"3497\">\n<p data-start=\"3465\" data-end=\"3497\">odrediti rok za pla\u0107anje poreza.<\/p>\n<\/li>\n<\/ol>\n<hr data-start=\"3499\" data-end=\"3502\">\n<h2 data-section-id=\"stt0xz\" data-start=\"3504\" data-end=\"3545\">Prijava poreza kod darovanja nekretnine<\/h2>\n<p data-start=\"3547\" data-end=\"3607\"><a style=\"background-color: #ffffff;\" href=\"https:\/\/lawyerincroatia.com\/porez-na-darovanje-nekretnine\/\" target=\"_blank\" rel=\"noopener\">Darovanje nekretnine tako\u0111er mo\u017ee uzrokovati poreznu obvezu.<\/a><\/p>\n<p data-start=\"3547\" data-end=\"3607\">U slu\u010daju&nbsp;darovanja nekretnine&nbsp;primjenjuju se pravila oporezivanja koja proizlaze iz poreznih propisa.<\/p>\n<p data-start=\"3702\" data-end=\"3823\">Me\u0111utim, zakon predvi\u0111a odre\u0111ena <strong data-start=\"3735\" data-end=\"3760\">oslobo\u0111enja od poreza<\/strong>, osobito kada se darovanje odvija izme\u0111u \u010dlanova u\u017ee obitelji.<\/p>\n<p data-start=\"3825\" data-end=\"3886\">Primjerice, porez se u pravilu ne pla\u0107a kod darovanja izme\u0111u:<\/p>\n<ul data-start=\"3888\" data-end=\"3969\">\n<li data-section-id=\"xam64q\" data-start=\"3888\" data-end=\"3909\">\n<p data-start=\"3890\" data-end=\"3909\">roditelja i djece<\/p>\n<\/li>\n<li data-section-id=\"tidnka\" data-start=\"3910\" data-end=\"3924\">\n<p data-start=\"3912\" data-end=\"3924\">supru\u017enika<\/p>\n<\/li>\n<li data-section-id=\"bqawfn\" data-start=\"3925\" data-end=\"3969\">\n<p data-start=\"3927\" data-end=\"3969\">bra\u0107e i sestara (u odre\u0111enim slu\u010dajevima).<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"3971\" data-end=\"4144\">Iako porezna obveza mo\u017eda ne\u0107e nastati, u praksi je \u010desto potrebno prijaviti takvu transakciju kako bi porezna uprava mogla utvrditi ispunjavaju li se uvjeti za oslobo\u0111enje.<\/p>\n<hr data-start=\"4146\" data-end=\"4149\">\n<h2 data-section-id=\"swbcfs\" data-start=\"4151\" data-end=\"4196\">Prijava poreza kod naslje\u0111ivanja nekretnine<\/h2>\n<p data-start=\"4198\" data-end=\"4263\">Naslje\u0111ivanje nekretnine tako\u0111er mo\u017ee zahtijevati prijavu poreza.<\/p>\n<p data-start=\"4265\" data-end=\"4370\">U pravilu se porez ne pla\u0107a kada nekretninu naslje\u0111uju <strong data-start=\"4320\" data-end=\"4357\">nasljednici prvog nasljednog reda<\/strong>, primjerice djeca ili supru\u017enici.<\/p>\n<p data-start=\"4397\" data-end=\"4514\">Ipak, postupak naslje\u0111ivanja uklju\u010duje pravomo\u0107no rje\u0161enje o naslje\u0111ivanju koje se dostavlja nadle\u017enim institucijama.<\/p>\n<p data-start=\"4516\" data-end=\"4665\">U odre\u0111enim situacijama porezna uprava mo\u017ee provesti postupak utvr\u0111ivanja poreza ako nasljednici ne pripadaju kategorijama koje su oslobo\u0111ene poreza.<\/p>\n<h2 data-section-id=\"1diouti\" data-start=\"4672\" data-end=\"4717\">Tko je du\u017ean prijaviti porez na nekretnine?<\/h2>\n<p data-start=\"4719\" data-end=\"4794\">Porez na nekretnine u pravilu prijavljuje <strong data-start=\"4761\" data-end=\"4793\">osoba koja stje\u010de nekretninu<\/strong>.<\/p>\n<p data-start=\"4796\" data-end=\"4809\">To mo\u017ee biti:<\/p>\n<ul data-start=\"4811\" data-end=\"4927\">\n<li data-section-id=\"1gfk4bv\" data-start=\"4811\" data-end=\"4831\">\n<p data-start=\"4813\" data-end=\"4831\">kupac nekretnine<\/p>\n<\/li>\n<li data-section-id=\"2qq674\" data-start=\"4832\" data-end=\"4849\">\n<p data-start=\"4834\" data-end=\"4849\">daroprimatelj<\/p>\n<\/li>\n<li data-section-id=\"h0rcfz\" data-start=\"4850\" data-end=\"4864\">\n<p data-start=\"4852\" data-end=\"4864\">nasljednik<\/p>\n<\/li>\n<li data-section-id=\"rtkzum\" data-start=\"4865\" data-end=\"4927\">\n<p data-start=\"4867\" data-end=\"4927\">osoba koja na drugi na\u010din stje\u010de vlasni\u0161tvo nad nekretninom.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"4929\" data-end=\"5086\">U slu\u010daju kada nekretninu stje\u010de vi\u0161e osoba, primjerice kod suvlasni\u0161tva, porezna obveza mo\u017ee se raspodijeliti izme\u0111u suvlasnika razmjerno njihovim udjelima.<\/p>\n<p data-start=\"5088\" data-end=\"5116\">Porezni obveznici mogu biti <b>fizi\u010dke osobe<\/b>, <b>pravne osobe<\/b> ili <b>strani dr\u017eavljani<\/b> koji stje\u010du nekretninu u Hrvatskoj.<\/p>\n<h2 data-section-id=\"1vu7gl3\" data-start=\"5215\" data-end=\"5262\">Gdje se podnosi prijava poreza na nekretnine?<\/h2>\n<p data-start=\"5264\" data-end=\"5352\">Prijava poreza na nekretnine podnosi se <b>nadle\u017enoj ispostavi<\/b> <strong data-start=\"5310\" data-end=\"5351\"><span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">Porezne uprave<\/span><\/span><\/strong>.<\/p>\n<p data-start=\"5354\" data-end=\"5390\">Nadle\u017enost se obi\u010dno odre\u0111uje prema lokaciji nekretnine i prebivali\u0161tu poreznog obveznika.<\/p>\n<p data-start=\"5452\" data-end=\"5495\">U praksi se porezna prijava mo\u017ee podnijeti:<\/p>\n<ul data-start=\"5497\" data-end=\"5606\">\n<li data-section-id=\"1rk46kf\" data-start=\"5497\" data-end=\"5538\">\n<p data-start=\"5499\" data-end=\"5538\">osobno u nadle\u017enoj poreznoj ispostavi<\/p>\n<\/li>\n<li data-section-id=\"a99xj2\" data-start=\"5539\" data-end=\"5554\">\n<p data-start=\"5541\" data-end=\"5554\">putem po\u0161te<\/p>\n<\/li>\n<li data-section-id=\"1mjqvbj\" data-start=\"5555\" data-end=\"5606\">\n<p data-start=\"5557\" data-end=\"5606\">elektroni\u010dkim putem ako je takva opcija dostupna.<\/p>\n<\/li>\n<\/ul>\n<h2 data-section-id=\"1sew6zv\" data-start=\"5613\" data-end=\"5650\">Porez na nekretnine: rok za prijavu<\/h2>\n<p data-start=\"5652\" data-end=\"5729\">Jedan od najva\u017enijih aspekata porezne prijave jest <strong data-start=\"5703\" data-end=\"5728\">rok za prijavu poreza<\/strong>.<\/p>\n<p data-start=\"5731\" data-end=\"5873\">Prema odredbama <strong data-start=\"5747\" data-end=\"5788\"><span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">Zakon o porezu na promet nekretnina<\/span><\/span><\/strong>, porezna prijava mora se podnijeti <strong data-start=\"5824\" data-end=\"5872\">u roku od 30 dana od nastanka porezne obveze<\/strong>.<\/p>\n<p data-start=\"5875\" data-end=\"5919\">Nastanak porezne obveze naj\u010de\u0161\u0107e se ve\u017ee uz:<\/p>\n<ul data-start=\"5921\" data-end=\"6031\">\n<li data-section-id=\"11ukkan\" data-start=\"5921\" data-end=\"5956\">\n<p data-start=\"5923\" data-end=\"5956\">sklapanje kupoprodajnog ugovora<\/p>\n<\/li>\n<li data-section-id=\"ghnz6z\" data-start=\"5957\" data-end=\"5990\">\n<p data-start=\"5959\" data-end=\"5990\">sklapanje ugovora o darovanju<\/p>\n<\/li>\n<li data-section-id=\"1yfc88d\" data-start=\"5991\" data-end=\"6031\">\n<p data-start=\"5993\" data-end=\"6031\">pravomo\u0107nost rje\u0161enja o naslje\u0111ivanju.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"6033\" data-end=\"6143\">Pravodobna prijava poreza izuzetno je va\u017ena jer propu\u0161tanje roka mo\u017ee dovesti do dodatnih tro\u0161kova i sankcija.<\/p>\n<h2 data-section-id=\"1pxesf8\" data-start=\"6150\" data-end=\"6201\">Koja dokumentacija je potrebna
