U Hrvatskoj se takve dra\u017ebe provode elektroni\u010dkim putem putem sustava koji vodi&nbsp;<a href=\"https:\/\/www.fina.hr\/\" target=\"_blank\" rel=\"noopener\">Financijska agencija (FINA)<\/a>&nbsp;i regulirane su prvenstveno kroz odredbe&nbsp;<a href=\"https:\/\/www.zakon.hr\/z\/74\/ovrsni-zakon\" target=\"_blank\" rel=\"noopener\">Ovr\u0161nog zakona<\/a>.<\/p>\n<p data-start=\"486\" data-end=\"673\">U ovom \u010dlanku detaljno obja\u0161njavamo \u0161to je javna dra\u017eba nekretnine, kako funkcionira, koji su njezini pravni u\u010dinci, rizici te \u0161to sudionici moraju znati prije nego se odlu\u010de sudjelovati.<\/p>\n<hr data-start=\"675\" data-end=\"678\">\n<h2 data-start=\"680\" data-end=\"714\">\u0160to je javna dra\u017eba nekretnine?<\/h2>\n<p data-start=\"716\" data-end=\"1042\">Javna dra\u017eba nekretnine je <strong data-start=\"743\" data-end=\"807\">prinudna prodaja nekretnine u ovr\u0161nom ili ste\u010dajnom postupku<\/strong>, kojoj je cilj namiriti vjerovnike ovr\u0161enika iz prodajne cijene nekretnine. U ovr\u0161nom postupku prodaja se naj\u010de\u0161\u0107e provodi nakon \u0161to je u zemlji\u0161nu knjigu upisana ovrha radi naplate nov\u010danog duga.<\/p>\n<p data-start=\"1044\" data-end=\"1257\">Danas se javne dra\u017ebe u Republici Hrvatskoj naj\u010de\u0161\u0107e provode <strong data-start=\"1105\" data-end=\"1148\">elektroni\u010dkom javnom dra\u017ebom (<a href=\"https:\/\/www.fina.hr\/javne-usluge\/e-drazba\" target=\"_blank\" rel=\"noopener\">e-dra\u017eba<\/a>)<\/strong> putem online sustava koji je uspostavljen od 1. sije\u010dnja 2015. godine.<\/p>\n<h2 data-start=\"1264\" data-end=\"1321\">U kojim situacijama dolazi do javne dra\u017ebe nekretnine?<\/h2>\n<p data-start=\"1323\" data-end=\"1383\">Do prodaje nekretnine na javnoj dra\u017ebi naj\u010de\u0161\u0107e dolazi kada:<\/p>\n<ul data-start=\"1385\" data-end=\"1682\">\n<li data-start=\"1385\" data-end=\"1461\">\n<p data-start=\"1387\" data-end=\"1461\">vjerovnik pokrene <strong data-start=\"1405\" data-end=\"1424\">ovr\u0161ni postupak<\/strong> protiv du\u017enika zbog nepla\u0107enog duga,<\/p>\n<\/li>\n<li data-start=\"1462\" data-end=\"1551\">\n<p data-start=\"1464\" data-end=\"1551\">sud ili ovr\u0161ni vjerovnik odredi prodaju nekretnine kako bi naplatio svoje potra\u017eivanje,<\/p>\n<\/li>\n<li data-start=\"1552\" data-end=\"1682\">\n<p data-start=\"1554\" data-end=\"1682\">u ste\u010dajnom postupku ste\u010dajni upravitelj odlu\u010di prodati imovinu radi namirenja vjerovnika.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1684\" data-end=\"1927\">Vrijednost nekretnine najprije se utvr\u0111uje odgovaraju\u0107im zaklju\u010dkom ovla\u0161tenog procjenitelja ili sudskog vje\u0161taka, uzimaju\u0107i u obzir relevantne terete i prava koja ostaju na nekretnini \u010dak i nakon prodaje.<\/p>\n<h2 data-start=\"1934\" data-end=\"1976\">Kako funkcionira javna dra\u017eba nekretnine?<\/h2>\n<h3 data-start=\"1978\" data-end=\"2027\">1. Pokretanje ovrhe i utvr\u0111ivanje vrijednosti<\/h3>\n<p data-start=\"2029\" data-end=\"2330\">Prije samog nadmetanja, vjerovnik mora pokrenuti ovr\u0161ni postupak i u zemlji\u0161nu knjigu uknji\u017eiti prijedlog za ovrhu na nekretnini. Nakon toga ovr\u0161ni ili sudski procjenitelj utvr\u0111uje vrijednost nekretnine koja \u0107e biti osnova za odre\u0111ivanje po\u010detne cijene na dra\u017ebi.<\/p>\n<hr data-start=\"2332\" data-end=\"2335\">\n<h3 data-start=\"2337\" data-end=\"2383\">2. Objavljuje se javna dra\u017eba nekretnine<\/h3>\n<p data-start=\"2385\" data-end=\"2624\">Prodaja nekretnine obavlja se putem elektroni\u010dke javne dra\u017ebe. Sud objavljuje poziv za sudjelovanje u dra\u017ebi koji sadr\u017ei sve relevantne informacije o predmetu prodaje, uvjetima sudjelovanja i rokovima.<\/p>\n<h3 data-start=\"2631\" data-end=\"2647\">3. Jam\u010devina<\/h3>\n<p data-start=\"2649\" data-end=\"2955\">Sudionici javne dra\u017ebe obi\u010dno moraju pravodobno uplatiti&nbsp;<a href=\"https:\/\/www.fina.hr\/javne-usluge\/e-drazba\/uplata-jamcevine-i-racuni-za-uplatu-jamcevina-kupovnina-naknada-u-postupku-e-drazbe\" target=\"_blank\" rel=\"noopener\">jam\u010devinu<\/a>&nbsp;prije po\u010detka dra\u017ebe. U obavijesti o dra\u017ebi navodi se iznos, na\u010din i rok uplate jam\u010devine. Ako sudionik ne uplati jam\u010devinu pravovremeno ili u propisanom iznosu, ne\u0107e mo\u0107i sudjelovati u nadmetanju.<\/p>\n<h3 data-start=\"2962\" data-end=\"2979\">4. Nadmetanje<\/h3>\n<p data-start=\"2981\" data-end=\"3263\">Nadmetanje je proces u kojem potencijalni kupci predla\u017eu svoje ponude. Ako je vi\u0161e sudionika, svatko mo\u017ee ponuditi ve\u0107u cijenu dok se ne utvrdi najpovoljnija ponuda. Ako je samo jedan sudionik, \u010desto mo\u017ee kupiti nekretninu po po\u010detnoj cijeni.<\/p>\n<h3 data-start=\"3270\" data-end=\"3303\">5. Minimalne cijene na dra\u017ebi<\/h3>\n<p data-start=\"3305\" data-end=\"3372\">Prema Ovr\u0161nom zakonu, minimalne prodajne cijene propisane su ovako:<\/p>\n<ul data-start=\"3374\" data-end=\"3726\">\n<li data-start=\"3374\" data-end=\"3485\">\n<p data-start=\"3376\" data-end=\"3485\"><strong data-start=\"3376\" data-end=\"3410\">Prva elektroni\u010dka javna dra\u017eba<\/strong>: nekretnina se ne mo\u017ee prodati ispod <strong data-start=\"3448\" data-end=\"3482\">4\/5 (80%) utvr\u0111ene vrijednosti<\/strong>.<\/p>\n<\/li>\n<li data-start=\"3486\" data-end=\"3598\">\n<p data-start=\"3488\" data-end=\"3598\"><strong data-start=\"3488\" data-end=\"3523\">Druga elektroni\u010dka javna dra\u017eba<\/strong>: nekretnina se ne mo\u017ee prodati ispod <strong data-start=\"3561\" data-end=\"3595\">3\/5 (60%) utvr\u0111ene vrijednosti<\/strong>.<\/p>\n<\/li>\n<li data-start=\"3599\" data-end=\"3726\">\n<p data-start=\"3601\" data-end=\"3726\">Ako se i na drugoj dra\u017ebi ne postigne prodaja, mo\u017ee se raspraviti daljnje postupanje.<\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"3733\" data-end=\"3766\">6. Zatvaranje dra\u017ebe i dosuda<\/h3>\n<p data-start=\"3768\" data-end=\"4178\">Elektroni\u010dka javna dra\u017eba zavr\u0161ava na unaprijed odre\u0111eni rok. Nakon zavr\u0161etka dra\u017ebe, FINA bez odgode obavje\u0161tava nadle\u017eni sud o rezultatima dra\u017ebe. Sud potom donosi <strong data-start=\"3934\" data-end=\"3966\">rje\u0161enje o dosudi nekretnine<\/strong> kupcu koji je ponudio najve\u0107u cijenu i ispunio sve formalne uvjete. Rje\u0161enje o dosudi objavljuje se na oglasnoj plo\u010di suda i na mre\u017enim stranicama relevantnih institucija.<\/p>\n<h2 data-start=\"4185\" data-end=\"4227\">Elektroni\u010dka javna dra\u017eba nekretnine: FINA sustav<\/h2>\n<p data-start=\"4229\" data-end=\"4280\">Elektroni\u010dka javna dra\u017eba putem e-Dra\u017ebe omogu\u0107uje:<\/p>\n<ul data-start=\"4282\" data-end=\"4463\">\n<li data-start=\"4282\" data-end=\"4323\">\n<p data-start=\"4284\" data-end=\"4323\">pregled i nadmetanje nekretnina <b>online<\/b>,<\/p>\n<\/li>\n<li data-start=\"4324\" data-end=\"4351\">\n<p data-start=\"4326\" data-end=\"4351\"><b>transparentnost <\/b>postupka,<\/p>\n<\/li>\n<li data-start=\"4352\" data-end=\"4463\">\n<p data-start=\"4354\" data-end=\"4463\"><b>besplatan pristup <\/b>javno dostupnim informacijama o predmetima prodaje.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"4465\" data-end=\"4674\">Putem sustava zainteresirani kupci mogu pratiti oglase, uvjete i tijek dra\u017ebi kroz&nbsp;<a href=\"https:\/\/ponip.fina.hr\/ocevidnik-web\/pocetna\" target=\"_blank\" rel=\"noopener\">O\u010devidnik nekretnina i pokretnina<\/a>&nbsp;te se registrirati za sudjelovanje u nadmetanju.<\/p>\n<h2 data-start=\"4681\" data-end=\"4734\">Javna dra\u017eba nekretnine: rizici i pravne posljedice<\/h2>\n<h2 data-start=\"4681\" data-end=\"4734\"><span style=\"color: #3b4d63; font-family: Inter, playfair; font-weight: 400; font-size: 18px;\">Kupnja nekretnine na javnoj dra\u017ebi mo\u017ee izgledati financijski privla\u010dna, ali nosi <\/span><b style=\"color: #3b4d63; font-family: Inter, playfair; font-size: 18px;\">zna\u010dajne rizike<\/b><span style=\"color: #3b4d63; font-family: Inter, playfair; font-weight: 400; font-size: 18px;\">:<\/span><\/h2>\n<h3 data-start=\"4829\" data-end=\"4860\">Tereti i prava tre\u0107ih osoba<\/h3>\n<p data-start=\"4862\" data-end=\"5059\">Nekretnina mo\u017ee biti <b>optere\u0107ena pravima tre\u0107ih osoba<\/b> (npr. zalo\u017ena prava, slu\u017enosti) koja ostaju \u010dak i nakon prodaje. Nu\u017eno je provjeriti stanje u zemlji\u0161nim knjigama prije sudjelovanja u dra\u017ebi.<\/p>\n<h3 data-start=\"5066\" data-end=\"5089\">Posjed i delo\u017eacija<\/h3>\n<p data-start=\"5091\" data-end=\"5282\">Ako nekretnina nije u posjedu prodavatelja ili ako postoje stanari, novi vlasnik mora <b>provesti postupak iseljenja<\/b> kroz sudski ili ovr\u0161ni postupak \u0161to mo\u017ee biti dugotrajnije i dodatno skupo.<\/p>\n<h3 data-start=\"5289\" data-end=\"5327\">Financijska i procesna odgovornost<\/h3>\n<p data-start=\"5329\" data-end=\"5503\">Uspje\u0161an kupac obvezan je <b>u propisanom roku<\/b> <b>platiti kupoprodajnu cijenu i preuzeti nekretninu<\/b>. Neispunjenje ovih obveza mo\u017ee dovesti do poni\u0161tenja dosude i gubitka jam\u010devine.<\/p>\n<h2 data-start=\"5510\" data-end=\"5538\">Prava i za\u0161tita ovr\u0161enika kod javne dra\u017ebe nekretnine<\/h2>\n<p data-start=\"5540\" data-end=\"5586\">Ovr\u0161eni vlasnik nekretnine ima zakonska prava:<\/p>\n<ul data-start=\"5588\" data-end=\"5941\">\n<li data-start=\"5588\" data-end=\"5653\">\n<p data-start=\"5590\" data-end=\"5653\">mo\u017ee <b>dati prijedlog za za\u0161titu svojih prava<\/b> u ovr\u0161nom postupku,<\/p>\n<\/li>\n<li data-start=\"5654\" data-end=\"5746\">\n<p data-start=\"5656\" data-end=\"5746\">mo\u017ee <b>predlo\u017eiti odgodu ovrhe<\/b> u odre\u0111enim slu\u010dajevima (npr. kada je nekretnina jedini dom),<\/p>\n<\/li>\n<li data-start=\"5747\" data-end=\"5941\">\n<p data-start=\"5749\" data-end=\"5941\">ako je nekretnina nu\u017ena za stambene potrebe, mo\u017ee imati <b>pravo na kori\u0161tenje kao najmoprimac<\/b> u odre\u0111enom razdoblju nakon prodaje sukladno Ovr\u0161nom zakonu.<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"5943\" data-end=\"5946\">\n<h2 data-start=\"5948\" data-end=\"5986\">Mo\u017ee li se zaustaviti javna dra\u017eba nekretnine?<\/h2>\n<p data-start=\"5988\" data-end=\"6058\">Javnu dra\u017ebu nekretnine mogu\u0107e je zaustaviti ili odgoditi samo ako se:<\/p>\n<ol>\n<li data-start=\"6060\" data-end=\"6105\">\n<p data-start=\"6062\" data-end=\"6105\">dug namiri prije prodaje cijele nekretnine,<\/p>\n<\/li>\n<li data-start=\"6106\" data-end=\"6140\">\n<p data-start=\"6108\" data-end=\"6140\">postigne sporazum s vjerovnikom,<\/p>\n<\/li>\n<li data-start=\"6141\" data-end=\"6220\">\n<p data-start=\"6143\" data-end=\"6220\">sud u skladu sa zakonom donese odluku o obustavi ovrhe prije po\u010detka prodaje.<\/p>\n<\/li>\n<\/ol>\n<p data-start=\"6222\" data-end=\"6311\">Takve situacije zahtijevaju pravnu strategiju i pravnu za\u0161titu u tijeku ovr\u0161nog postupka.<\/p>\n<h2 data-start=\"6318\" data-end=\"6367\">Porezne obveze kod kupnje nekretnine na javnoj dra\u017ebi<\/h2>\n<p data-start=\"6369\" data-end=\"6672\">Kupac nekretnine na dra\u017ebi obi\u010dno je obvezan platiti <strong data-start=\"6422\" data-end=\"6452\">porez na promet nekretnina<\/strong> sukladno va\u017ee\u0107im poreznim propisima, osim ako se nekretnina ne prodaje u postupku u kojem bi bila obuhva\u0107ena posebna pravila oporezivanja. Pravne posljedice poreznog tretmana trebaju se dodatno analizirati prije kupnje.<\/p>\n<h2 data-start=\"6679\" data-end=\"6691\">Javna dra\u017eba nekretnine je prilika, ali i rizik<\/h2>\n<p data-start=\"6693\" data-end=\"6850\">Javna dra\u017eba nekretnine predstavlja slo\u017een i formalno zahtjevan pravni postupak s brojnim rizicima i pravnim posljedicama.
