Sama \u010dinjenica da stranke pravnog odnosa potje\u010du iz razli\u010ditih dr\u017eava dovoljna je da taj odnos sadr\u017ei me\u0111unarodni element, neovisno o tome gdje je ugovor sklopljen ili gdje se izvr\u0161ava.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f4f5e86 elementor-widget elementor-widget-heading\" data-id=\"f4f5e86\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">\u0160to je me\u0111unarodno privatno pravo?<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-eed86bd elementor-widget elementor-widget-text-editor\" data-id=\"eed86bd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>U svojoj strogoj pravnoj definiciji, me\u0111unarodno privatno pravo predstavlja skup pravnih pravila koja ure\u0111uju privatnopravne odnose s inozemnim elementom, odnosno situacije u kojima su osobe, imovina ili doga\u0111aji povezani s vi\u0161e od jedne dr\u017eave uklju\u010deni u isti pravni odnos. Takvi se odnosi razlikuju od isklju\u010divo doma\u0107ih pravnih odnosa upravo zato \u0161to prelaze granice jedne dr\u017eave.<\/p><p>Danas prekograni\u010dna pravna aktivnost vi\u0161e nije iznimka, nego pravilo, osobito u kontekstu intenzivne gospodarske suradnje, digitaliziranog poslovanja te slobodnog kretanja robe, usluga, kapitala i osoba.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a2023d6 elementor-widget elementor-widget-heading\" data-id=\"a2023d6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Svrha me\u0111unarodnog privatnog prava u prekograni\u010dnim odnosima.<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-2cb84a0 e-flex e-con-boxed wpr-particle-no wpr-jarallax-no wpr-parallax-no wpr-sticky-section-no wpr-equal-height-no e-con e-parent\" data-id=\"2cb84a0\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-181531e elementor-widget elementor-widget-text-editor\" data-id=\"181531e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Temeljna svrha me\u0111unarodnog privatnog prava jest pru\u017eiti jasne odgovore na tri prakti\u010dna pitanja koja se naj\u010de\u0161\u0107e pojavljuju u prekograni\u010dnim situacijama:<\/p><ul><li>koje pravo ure\u0111uje odre\u0111eni pravni odnos,<\/li><li>koji sud ili tijelo ima nadle\u017enost za rje\u0161avanje spora, i<\/li><li>strane sudske odluke mogu biti priznate i ovr\u0161ene, ali odgovor u cijelosti ovisi o tome koje su dr\u017eave uklju\u010dene, o kojoj je vrsti odluke rije\u010d i koji se pravni okvir primjenjuje.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d04b4be elementor-widget elementor-widget-heading\" data-id=\"d04b4be\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Mjerodavno pravo i nadle\u017enost u me\u0111unarodnim sporovima.<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d2e3a0d elementor-widget elementor-widget-text-editor\" data-id=\"d2e3a0d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>U takvim okolnostima neizbje\u017eno se postavljaju pitanja mjerodavnog prava, odnosno koja pravna pravila ure\u0111uju odnos, te nadle\u017enosti, odnosno koji je sud nadle\u017ean odlu\u010diti o sporu. Odgovore na ta pitanja daju kako nacionalni propisi uklju\u010denih dr\u017eava, tako i me\u0111unarodni izvori prava, osobito uredbe European Union, koje se izravno primjenjuju i imaju prednost pred nacionalnim zakonodavstvom.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-eaa338e elementor-widget elementor-widget-heading\" data-id=\"eaa338e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Uloga prava Europske unije u me\u0111unarodnom privatnom pravu<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-23fa7d4 elementor-widget elementor-widget-text-editor\" data-id=\"23fa7d4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>S obzirom na \u010dlanstvo Republike Hrvatske u European Union, rje\u0161avanje privatnopravnih odnosa s me\u0111unarodnim elementom u velikoj je mjeri uskla\u0111eno i ure\u0111eno izravno primjenjivim propisima Europske unije. Ti su pravni okviri \u010desto fragmentirani, me\u0111usobno povezani i podlo\u017eni \u010destim izmjenama, \u0161to zahtijeva njihovo tuma\u010denje u svjetlu prava Europske unije i sudske prakse Court of Justice of the European Union.<\/p><p>Neosiguravanje uskla\u0111enosti mo\u017ee dovesti do ozbiljnih pravnih i financijskih posljedica, uklju\u010duju\u0107i znatne nov\u010dane kazne, upravne mjere te naru\u0161avanje povjerenja i stabilnosti poslovnih odnosa s poslovnim partnerima.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5d462d3 elementor-widget elementor-widget-heading\" data-id=\"5d462d3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Za\u0161to je pravna stru\u010dnost u me\u0111unarodnom privatnom pravu klju\u010dna.<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1fa33eb elementor-widget elementor-widget-text-editor\" data-id=\"1fa33eb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Va\u017enost razumijevanja i snala\u017eenja u me\u0111unarodnom privatnom pravu je o\u010dita.
